WHEREAS;
"Law 11-270, the "Anti-Loitering/Drug Free Zone," was introduced in Council and assigned Bill No. 11-441, which was referred to the Committee on the Judiciary. The Bill was adopted first and second readings on June 6, 1996, and July 3, 1996, respectively. Signed by the Mayor on July 19, 1996, it was assigned Act No. 11-321 and transmitted to both houses of Congress for its review. D.C. Law 11-270 became effective on June 3, 1997." It has been codified to the D.C. Official Code as ?? 48-1001 through 1005. The Anti-Loitering/Drug Free Zone Act was amended by section 226 of the Omnibus Public Safety Emergency Amendment Act of 2006, enacted on July 19, 2006 (D.C. Act 16-445).

WHEREAS;
The Anti-Loitering/Drug Free Zone Act of 1996, as amended (hereafter, "the Act") provides, among other things, that the Chief of Police may declare any public area a drug free zone for a period not to exceed 240 consecutive hours, based on the following considerations:

"The occurrence of a disproportionately high number of arrests for the possession or distribution of illegal drugs in the proposed drug free zone within the preceding 6-month period;

Any number of homicides related to the possession or distribution of illegal drugs that were committed in the proposed drug free zone within the preceding 6-month period;

Objective evidence or verifiable information that shows that illegal drugs are being sold and distributed on public space on public property within the proposed drug free zone; and

Any other verifiable information from which the Chief of Police may ascertain whether the health or safety of residents who live in the proposed drug free zone are endangered by the purchase, sale, or use of illegal drugs or other illegal activity." (DC Official Code ? 48-1002(b))

WHEREAS;
The Metropolitan Police Department has issued appropriate directives (Special Order 03-02) to its members describing the requirements of the Act and providing operational guidelines for enforcing the Act.

WHEREAS;
Information pertaining to the above-listed considerations has been supplied to me by the Commander of the police district within which the following area is situated, and further information of the same nature is available to me from reliable sources, including, among other things, confidential police investigative reports.

NOW THEREFORE;
I hereby determine and declare that the following described area shall be designated as a drug free zone and that the respective police commander shall take all steps necessary to enforce the provisions of the Act in accordance with all applicable directives and operational guidelines of the Metropolitan Police Department:

DRUG FREE ZONE ESTABLISHED

Boundaries of Drug Free Zone:
Starting at the northwest corner of the zone at the intersection of the southern curbline of Benning Rd., NE and the western curbline of 17th St., NE, proceeding eastward along the curbline to the intersection of the curbline and the western curbline of 19th St., NE, proceeding southward along the curbline of the intersection of the curbline and the southern curbline of Rosedale St., NE, proceeding westward along the curbline to the intersection of the curbline and the western curbline of 18th St., NE, proceeding northward along the curbline to the intersection of the curbline and the southern curbline of Gales St., NE, proceeding westward along the curbline to the intersection of the curbline and the western curbline of 17th St., NE, proceeding northward along the curbline to the starting point.

Effective Dates and Times:

Death Investigation on Fourth Street, NE

Death Investigation on Fourth Street, NE
Detectives assigned to the Metropolitan Police Department's Homicide Branch are currently investigating a death which occurred inside of a business establishment located at 2300 Fourth Street, NE.

On Tuesday, August 18, 2009, at approximately 12:20 pm, members of the Fifth District were flagged down by a concerned citizen to check on the welfare of the owner of the Pizza Mart located at 2300 Fourth Street, NE. Upon entering the establishment, an adult male was observed unconscious and unresponsive lying on the floor. DC Fire and Emergency Medical Services Department personnel responded and determined that there were no signs of life. The decedent has been identified as 44-year-old Shahabuddin Rana of the 800 block of Sligo Avenue in Silver Spring, Maryland.

The cause and manner of death of the decedent are pending an autopsy to be performed by the Office of the Chief Medical Examiner for the District of Columbia; however, the death is being investigated as a homicide at this time.


Anyone with information about this case is asked to call police at (202) 727-9099 or 1-888-919-CRIM[E] (1-888-919-2746). The Metropolitan Police Department is currently offering a reward of up to $25,000 to anyone who provides information which leads to the arrest and conviction of the person or persons responsible for any homicide committed in the District of Columbia.


Anonymous information may also be forwarded to the department's Crime Solvers Unit at 1-866- 411-TIPS and to the department's TEXT TIP LINE by text messaging 50411. If the information provided by a caller to Crime Solvers leads to an arrest and indictment, that caller will be eligible for a reward of up to $1,000.

Fenty Statement on Signing of Omnibus Crime Bill

Mayor Adrian M. Fenty issued the following statement today as he signed the Omnibus Public Safety and Justice Emergency Amendment Act of 2009. The legislation was first introduced by the Fenty Administration in October 2008, and was revised in February 2009.

"Today marks an important step forward in fighting crime in the District of Columbia. The Omnibus Public Safety and Justice Emergency Amendment Act of 2009 provides the District with tougher laws that increase penalties for violent crimes, allowing us to effectively send a message to criminals in an effort to deter potential crimes from even taking place. The emergency bill I’ve signed today, will allow law enforcement officials to begin using these tools to combat crime in the District, especially in the summer months. I greatly appreciate the Council's support on this crucial legislation, and look forward to continuing to work together to keep our neighborhoods safe.”

Homicide in the 1500 block of Pennsylvania Avenue

Victim Identified in the Homicide in the 1500 block of Pennsylvania Avenue, SE
The Metropolitan Police Department’s Homicide Branch has identified the victim in a homicide which occurred in the 1500 block of Pennsylvania Ave. SE. The victim has been identified as 56-year-old Michael Burnett of that address.

At approximately 6:15 pm on Monday, August 10, 2009, officers from the First District responded to the 1500 block of Pennsylvania Avenue, SE for the report of a shooting. Upon arrival, they discovered Mr. Burnett suffering from multiple gunshot wounds. Personnel from the DC Fire and Emergency Medical Services Department responded to the scene and transported Mr. Burnett to a local hospital, where he succumbed to his injuries and was pronounced dead.


Police arrested 36-year-old Kristin Burnett, of the same address, in connection with the shooting death. She has been charged with Murder Two While Armed. The suspect has been identified as the wife of the decedent.

Traffic Fatality on Kenilworth Avenue, NE
The Metropolitan Police Department is currently investigating a single vehicle traffic fatality which occurred in the 1300 block of Kenilworth Avenue, NE.

At approximately 5:53 pm on Saturday, August 8, 2009, an adult male was reportedly operating a 2001 Ford Mustang at a high rate of speed northbound in the 1300 block of Kenilworth Avenue, NE. At that time the operator reportedly lost control of the vehicle and struck a “Jersey barrier” before coming to a rest. During the course of this accident, an adult female who was the front seat passenger was partially ejected from the vehicle.

Personnel from the DC Fire and Emergency Medical Services Department responded to the scene, but were unable to find any signs from the woman consistent with life. She was subsequently pronounced dead on the scene by a representative from the Office of the Chief Medical Examiner for the District of Columbia.

The decedent in this case has been identified as 28-year-old Diona Shaunte Anthony of the 7000 block of Independence Street in Capitol Heights, Maryland.

A subsequent investigation led to the arrest of the operator of the vehicle who has been identified as 34-year-old Erik Anthony Bingham of Hyattsville, Maryland. Mr. Bingham is currently being charged with Driving under the Influence in connection with this case. He was transported to an area hospital for treatment of apparently non-life threatening injuries.


The circumstances surrounding this traffic fatality remain under investigation by members assigned to the department’s Major Crash Investigations Unit.

Effective Friday, August 14, 2009 at 6:00 pm the Brentwood Service Center located at 1233 Brentwood Road, NE will permanently close operations. After August 14, please visit our 3 other DMV Service Centers located at: Georgetown Park Mall (3222 M Street, NW); Penn Branch Shopping Center (3220 Pennsylvania Ave., SE); and Southwest (95 M Street, SW) for driver and vehicle services. The DMV now provides many driver/identification, vehicle, adjudication and general transactions online. Using these services, customers can "skip the trip" to DMV offices, save time and conduct business with DMV wherever and whenever they choose.

Now more than ever, it’s time to get involved, and National Night Out 2009 provides the perfect avenue to do so. On Tuesday, August 4, thousands of DC residents are expected to join with their neighbors, police officers and other community leaders in celebrating National Night Out. From community cookouts to open houses – block parties, candlelight vigils and athletic events – DC is gearing up for the 26th annual celebration of “America’s Night Out Against Crime.” The citywide kickoff will begin at 5 pm at the THEARC, 1901 Mississippi Avenue, SE, with food, music, sports and games, crime prevention displays and other activities for participants of all ages. Public safety characters McGruff the Crime Dog® and the National
Knight® will be available to meet attendees and have their photos taken. In addition to the numerous activities taking place at the kickoff event, communities across DC – in all seven police districts – have scheduled NNO events during the late afternoon and evening hours.

TO ISSUE TRAFFIC CITATIONS
The District Department of Transportation’s (DDOT) Traffic Control Officers (TCOs) have recently completed training allowing them to issue citations for traffic infractions. In response to legislation passed by City Council and introduced by Councilmember Jim Graham, DDOT’s TCOs are able to write tickets for traffic violations such as parking in a bus or loading zone, parking in a no standing zone or double parking.

DDOT TCOs are routinely deployed to some of the District’s busiest intersections to help facilitate traffic through morning and evening rush hours and as such are in a unique position to observe real-time violations by motorists and pedestrians. TCOs ensure the public right-of-way is kept safe for all modes of transportation including bicyclists and pedestrians and may also issue citations for blocking crosswalks and bike lanes as well as for distracted driving, illegal use of cell phones, etc.

The TCOs have received 40 hours of training from the Metropolitan Police Department (MPD) on the regulations and procedures for issuing traffic citations. The DC Code gives the TCOs the authority to issue citations for parking infractions and minor moving violations, including:

• Parking in a bus or loading zone
• Parking in front of a designated entrance
• Expired tags
• No standing
• No parking anytime
• Double parking
• No parking during rush hour
• Expired inspection sticker
• No stopping
• No front or rear tag
Generally, TCOs cannot write tickets for criminal violations that are not subject to
administrative traffic adjudication at the Department of Motor Vehicles (DMV).
